Refund policy

§1. General provisions

  1. This Refund Policy sets out the rules for withdrawal from the contract and complaints regarding products purchased in the online store malpetit.com (hereinafter: the "Store").
  2. The seller is Mykhailo Petrenko, conducting business activity under the brand "Malpetit", NIP: 5214092812, REGON: 540111282, business address: Taśmowa 8B/27, 02-677 Warszawa, email: contact@malpetit.com (hereinafter: the "Seller").
  3. The Policy applies to Consumers as well as natural persons running a sole proprietorship concluding a contract directly related to their business activity, when it follows from the content of this contract that it does not have a professional character for them.
  4. Legal basis: Polish Consumer Rights Act of 30 May 2014 (Journal of Laws 2014 item 827, as amended), Polish Civil Code (Article 556 et seq.).

§2. Right of withdrawal

  1. The Consumer has the right to withdraw from the sales contract within 14 days of taking possession of the product, without giving any reason and without incurring costs other than those specified in this Policy.
  2. The withdrawal period expires 14 days from the day on which the Consumer comes into possession of the goods, or a third party other than the carrier and indicated by the Consumer comes into possession of the goods.
  3. To exercise the right of withdrawal, the Consumer must inform the Seller of their decision by an unambiguous statement (e.g., a letter sent by post or email to contact@malpetit.com).
  4. The Consumer may use the model withdrawal form (Annex No. 1), but this is not obligatory.
  5. To meet the deadline, it is sufficient to send the statement before its expiry.

§3. Effects of withdrawal

  1. In the event of withdrawal from the contract, the Seller reimburses the Consumer for all payments received, including the cost of delivery (except for additional costs resulting from the chosen delivery method other than the cheapest standard delivery method offered by the Store), without undue delay and in any event no later than 14 days from the day on which the Seller is informed of the decision to withdraw.
  2. The reimbursement will be made using the same means of payment as those used by the Consumer for the initial transaction, unless the Consumer expressly agrees otherwise. In any case, the Consumer will not incur any fees as a result of this reimbursement.
  3. The Seller may withhold reimbursement until the goods have been received back or until the Consumer has supplied evidence of having sent the goods back, whichever is the earliest.
  4. The Consumer is liable for any diminished value of the product resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

§4. Return shipping costs (hybrid model)

4.1. Free return — Seller covers shipping cost

The Seller covers the return shipping cost (return label provided to the Consumer) when the return results from:

  • manufacturing defect (damage, non-conformity with description, production defect);
  • Seller's error (sending the wrong size, colour, or variant);
  • damage to the product in transit (confirmed by a damage report).

4.2. Return at Buyer's cost

The Buyer covers the return shipping cost when the return results from:

  • change of decision by the Consumer (e.g., "I changed my mind", "doesn't fit");
  • choosing the wrong size or variant despite available size charts and descriptions;
  • other subjective evaluation of a product that was delivered in accordance with the description and without defects.

In this case, the Buyer chooses the carrier and pays for return shipping.

4.3. Note

Upon receiving the return request, the Seller determines whether the return qualifies as free (category 4.1) and provides the Consumer with instructions and a return label, or instructions for self-shipping (category 4.2).

§5. Conditions of the returned product

  1. The returned product must:
    • be complete (with all elements of the purchased set);
    • be in unused condition, without traces of wear, washing, stains, or damage;
    • have original tags and packaging;
    • be returned in the original form in which it was delivered.
  2. The Seller reserves the right to refuse the return or reduce the refund amount if the product shows traces of use beyond ordinary verification of the nature, characteristics, and functioning of the goods. The Consumer will be informed of the reason and amount of any reduction.

§6. Return procedure — step by step

  1. Return notification — The Buyer sends an email to contact@malpetit.com within 14 days of receiving the product, containing:
    • order number,
    • description of the reason for return,
    • indication of products being returned,
    • preferred payment refund method.
  2. Seller's response — within 1–2 working days, the Seller:
    • sends the Buyer return instructions along with a return label (if it qualifies as a free return),
    • or provides the return address (if the Buyer covers the cost).
  3. Shipping — The Buyer packs the product in its original packaging, applies the label, and sends the parcel at a chosen point or parcel locker.
  4. Verification — upon receiving the parcel, the Seller verifies the product within 2–3 working days.
  5. Payment refund — in case of positive verification, the refund is made within 5 working days of the product being accepted.

§7. Exceptions to the right of withdrawal

In accordance with Article 38 of the Polish Consumer Rights Act, the right of withdrawal does not apply to:

  1. products manufactured to the Consumer's specifications or serving to meet their individualised needs (e.g., personalisation, monograms, custom sizes);
  2. products which, after delivery, have been unsealed and, due to health protection or hygiene reasons, are not suitable for return (e.g., dog hygiene products, opened food, opened treats, opened cosmetics);
  3. products that are perishable or have a short use-by date;
  4. services whose performance has begun — with the explicit consent of the Consumer — before the withdrawal period expired.

§8. Statutory warranty claims (rękojmia)

  1. The Seller is liable for physical and legal defects of the product in accordance with the Polish Civil Code (Article 556 et seq.).
  2. The Buyer may submit a statutory warranty claim within 2 years of the date of product delivery, if the defect existed at the time the risk passed to the Buyer or results from a cause inherent in the sold item at that time.
  3. The claim should be submitted to contact@malpetit.com along with:
    • order number,
    • description of the defect,
    • photo of the defect (if visible),
    • expected resolution (repair, replacement, price reduction, refund).
  4. The Seller will process the claim within 14 days of its receipt.
  5. The cost of a justified claim is fully covered by the Seller, including return shipping costs.

§9. Out-of-court dispute resolution

  1. The Buyer has the right to use out-of-court methods of handling complaints and pursuing claims.
  2. In particular, the Buyer may:

§10. Final provisions

  1. This Policy enters into force on 28.05.2026.
  2. Any changes to the Policy will be published on the store's website with 14 days' notice, and existing orders will be processed according to the Policy in force on the day they were placed.
  3. In matters not regulated by this Policy, the provisions of Polish law shall apply, in particular the Consumer Rights Act and the Civil Code.
