Terms of service

§1. General provisions

1. These Terms of Service set out the rules for using the online store malpetit.com (hereinafter: the "Store") and concluding sales contracts via the Store.
2. The Store is operated by Mykhailo Petrenko, conducting business activity under the brand "Malpetit", NIP: 5214092812, REGON: 540111282, registered address: Taśmowa 8B/27, 02-677 Warszawa, Poland, email: contact@malpetit.com (hereinafter: the "Seller").
3. The Terms apply to all Customers - both Consumers and entrepreneurs purchasing for business purposes.
4. Legal basis: Polish Civil Code, Consumer Rights Act of 30 May 2014, Act on Electronic Services of 18 July 2002.

§2. Orders

1. The Customer places an order via the Store at malpetit.com - 24/7.
2. The sales contract is concluded at the moment the Seller confirms acceptance of the order by email.
3. Prices are in PLN. As a small business, the Seller is exempt from VAT under art. 113 of the Polish VAT Act, so no VAT is added to the prices. Delivery cost is shown at checkout.
   
4. The Seller reserves the right to refuse an order in case of: incorrect address, suspected fraud, lack of stock, or pricing error caused by a system fault.

§3. Payment

1. The Store accepts the following payment methods:
   • Card payments (Visa, Mastercard) via Shopify Payments;
   • Apple Pay / Google Pay;
   • Shop Pay;
   • BLIK and PayPo (where available);
   • Bank transfer (where available).
2. The Customer must complete payment within 3 days of order placement; otherwise the order is automatically cancelled.
3. As a VAT-exempt business, the Seller does not issue VAT invoices. A receipt (rachunek) is issued on request - the Customer should send their billing data to contact@malpetit.com within 7 days of purchas

    

§4. Delivery

1. Detailed delivery terms, costs, and times are set out in the Shipping Policy.
2. The Seller dispatches goods within 1-3 working days of order confirmation and payment.
3. The Customer is responsible for providing accurate delivery details. The Seller is not liable for delays caused by incorrect address.

§5. Returns and complaints

Detailed return rules and statutory warranty (rękojmia) procedures are set out in the Refund and Complaints Policy. Consumers have 14 days to withdraw from a distance sales contract without giving any reason.

§6. Customer accounts

1. The Customer may purchase as a guest (without an account) or create an account.
2. The account is created free of charge and used to track orders, save addresses, and access purchase history.
3. The Customer is responsible for keeping account credentials confidential.
4. The Customer may delete their account at any time by writing to contact@malpetit.com.

§7. Intellectual property

All content on the Store - including product photographs, descriptions, the "Malpetit" name and logo - is protected by copyright. Use of this content for commercial purposes without the Seller's written consent is prohibited.

§8. Privacy

Customer personal data is processed in accordance with the Privacy Policy.

§9. Dispute resolution

1. The Customer has the right to use out-of-court methods of handling complaints, in particular:
   • mediation conducted by Provincial Inspectorates of Trade Inspection (uokik.gov.pl);
   • the EU ODR platform: ec.europa.eu/consumers/odr.
2. Court jurisdiction is determined according to Polish Code of Civil Procedure.

§10. Final provisions

1. The Seller reserves the right to amend the Terms with 14 days' notice. Existing orders are processed under the Terms in force at the time of placement.
2. In matters not regulated by these Terms, Polish law applies.
3. The Terms enter into force on 28.05.2026.
